The change, set to take effect today, March 11, will make it much harder for workers to qualify as independent contractors.
 
The rule will set up a subjective, six-factor test for determining worker status, and create an undefined set of “additional factors” that might also be considered. This is a significant departure from the current test that relies on two core factors and has created a predictable system that allows workers to choose the style of work that suits them best.
 
The new standard will invite confusion and unpredictability in the workplace, since worker status will largely depend on who is conducting the test and what factors they view as important. We believe it will ultimately force millions of independent contractors to give up that status and become company employees. This will limit opportunities for people to work as independent contractors and hurt hotels’ ability to maintain operations.
 
The American Hotel & Lodging Association is considering a range of potential next steps against this rule, including possible litigation and the National Restaurant Association is urging Congress to authorize a CRA of the new rule. In the meantime, operators should review their use of independent contractors and consult with an attorney proactively to insure compliance.

US Judge Blocks U.S. Labor Board's Rule, Franchise Model Restored https://www.scrla.org/news/667429/ https://www.scrla.org/news/667429/ Today, the U.S. District Court for the Eastern District of Texas blocked a National Labor Relations Board (NLRB) rule to change the way joint-employer status is determined. In its decision, the court also reinstated a 2020 NLRB rule that protects businesses from undue liability for employees over whom they do not have direct control. In October 2023, the NLRB released a final rule that, starting on March 11, would have changed the standard the federal government uses to determine when two or more employers are jointly responsible for a shared group of workers’ terms and conditions of employment. The rule was designed to force franchisors to the negotiating table with workers they do not actually employ to increase unionization. In November, NRA, AHLA, and others filed a lawsuit challenging the rule’s legality. The court’s March 8 decision overturns the new rule and reinstates a 2020 NLRB rule that protects businesses from undue liability for employees over whom they do not have direct control. The announcement follows a Notice of Proposed Rulemaking on October 13, 2022, which led to thousands of comments from a diverse array of stakeholders that helped inform the regulatory updates.

 

The final rule, Employee or Independent Contractor Classification Under the Fair Labor Standards Act, provides guidance on whether a worker is an employee or independent contractor under the FLSA. Misclassification is a serious issue that denies employees’ rights and protections under federal labor laws and hurts the economy at-large. The Department believes this final rule will protect workers from misclassification, while at the same time providing a consistent approach for those businesses that engage (or wish to engage) with independent contractors.

 

It is the Department’s obligation to administer and enforce the FLSA to ensure that workers who should be covered under the Act are properly classified as employees. This final rule ensures that such workers receive the FLSA’s wage and hour protections, and that employers that comply with the law are not placed at a competitive disadvantage when competing against employers that misclassify employees. The final rule also aligns the department’s approach with longstanding judicial precedent, which will reduce confusion, improve compliance, and better protect working people.

 

Specifically, the final rule does the following:  

  • Restores the multifactor, totality-of-the-circumstances analysis to assess whether a worker is an employee or an independent contractor under the FLSA. 
  • Ensures that all factors are analyzed without assigning a predetermined weight to a particular factor or set of factors. 
  • Uses the longstanding interpretation of the economic reality factors. These factors include opportunity for profit or loss depending on managerial skill, investments by the worker and the potential employer, the degree of permanence of the work relationship, the nature and degree of control, the extent to which the work performed is an integral part of the potential employer’s business, and the worker’s skill and initiative. 
  • Rescinds the 2021 Independent Contractor Rule.

Federal regulators have proposed a national ban on common service fees and surcharges restaurants and hotels use.  

The Federal Trade Commission’s (FTC) proposed rule could force operators of all sizes to rewrite compensation models, increase prices, and overhaul established business practices. The FTC admits it would cost restaurants at least $3.5 billion to comply with their plan.  

The National Restaurant Association and the American Hotel & Lodging Association are working in Washington to resist this regulatory overreach, but the FTC needs to hear from operators like you.

Our partners at The National Restaurant Association and the American Hotel & Lodging Association have been aggressively lobbying the Biden administration and Congress to expand the number of visas available through the H-2B visa program. While these additional visas will provide crucial help to seasonal businesses in SC, we recognize they will not be enough to meet our industry's ongoing labor needs in this competitive job market. The General Services Administration (GSA) has announced its Fiscal Year 2024 per diem rates.

 

The per diem guidelines announced govern reimbursement for government employees’ lodging and meal expenses for official government travel and include a $9 increase to the standard lodging rate as well as large increases in rates in many non-standard areas (Charleston, Columbia, Hilton Head and Columbia).

 

This is a positive step for many hoteliers across, as government travel supports billions in travel spending, and many private-sector organizations also base travel reimbursements on federal per diem rates.

 

The FY2024 standard per diem:

  • $107 lodging (increased from $98)
  • $59 meals (unchanged)

Team South Carolina Shines at National ProStart Invitational

 

Team South Carolina battled more than 400 competitors at the 2023 National ProStart Invitational earlier this month in Washington, D.C. Anderson Career and Technology Center (ACTC) placed fourth in the Culinary Arts Competition, while Golden Strip Career Center placed 20th in Restaurant Management.

 

The event featured a show-stopping display of culinary talent and restaurant business acumen by over 90 of the country’s best and brightest high school teams from 46 states. All students competing in the National ProStart Invitational earned their place by winning their state-level ProStart Invitational competitions.

 

ACTC serves students from Belton-Honea Path, Palmetto, Powdersville, and Wren High Schools in the Anderson I & II School Districts. Golden Strip serves students from Hillcrest, Mauldin and J.L. Mann High Schools in Greenville County Schools.

 

Established in 1995 by the National Restaurant Association Education Foundation (NRAEF), ProStart has equipped 1 million high school students to date with career ready culinary and restaurant management skills. Today, the program reaches nearly 165,000 students at almost 1,850 schools, who emerge ready to build a career in the restaurant and hospitality industry. South Carolina ProStart was introduced in 1999 and reaches 54 schools statewide.

 

“The passion and talent displayed by the National ProStart Invitational competitors was truly awe-inspiring, giving us a front row seat to the next generation that will shape our industry,” said NRAEF President Rob Gifford. “Thanks to the daily work of our educators, ProStart is equipping these students with crucial career-building skills that will enhance their lives in the industry, or wherever their futures take them.” 

 

The National ProStart Invitational is a high-stakes competition between some of the best culinary and restaurant management students in the country. Students on the culinary teams had 60 minutes to prepare a three course, fine dining menu, using only two butane burners and no running water. The management teams persuaded a panel of judges that their innovative restaurant business pitches had the chops to succeed in the real world.

 

Going head-to-head against 45 fellow teams, ACTC’s menu consisted of sea scallops with potato croquettes and a spring vegetable salad as a starter, and pan-seared squab with creamy parsnip puree, braised turnip greens, and a fig reduction sauce to follow. They completed their menu with a deconstructed carrot cake with cream cheese whipped ganache, pineapple cream and carrot sorbet.

 

More than 70 industry and post-secondary judges were on hand to select the winning teams. Students were evaluated on their uniform and professional appearance, teamwork, decision making ability, product taste, and overall menu appeal. The top 10 winning teams earned more than $200,000 in scholarships.

 

South Carolina’s Educator of Excellence nominee, Kimberly Bush, will travel to Dallas, TX in July for the Educator of Excellence Awards Ceremony and ProStart professional development training. Bush, a ProStart instructor at South Aiken High School, is recognized for sharing her experiences in the hospitality industry and her contributions to culinary education.

Upstate Schools Place First in South Carolina ProStart Invitational https://www.scrla.org/news/634583/ https://www.scrla.org/news/634583/ Presented by the United States Coast Guard, the South Carolina Restaurant and Lodging Foundation hosted its 19th Annual South Carolina ProStart Invitational on March 6 at the DoubleTree by Hilton Resort Myrtle Beach Oceanfront. More than 150 students from 20 high schools demonstrated their business acumen and culinary arts skill set at the statewide competition. 


Students from Anderson Career and Technology Center (ACTC) won first place in the Culinary Arts Competition, while Golden Strip Career Center (GSCC) won first place in the Restaurant Management Competition. Both competitions were hosted by Cool Care Heating, Air, Plumbing and Refrigeration.


ACTC school serves students from Belton-Honea Path, Palmetto, Powdersville, and Wren High Schools in the Anderson I & II School Districts. Golden Strip serves students from Hillcrest, Mauldin and J.L. Mann High Schools in Greenville County Schools.


ProStart is a national two-year program offered at participating schools across the country for high school juniors and seniors interested in the culinary arts. Established in 1999, South Carolina's ProStart is run by the SCRLF and the National Restaurant Association Education Foundation, and provides high school and college academic credit, scholarships, and paid work opportunities for students. The program is much more than a typical high school curriculum as it unites the foodservice industry and the classroom to teach high school students culinary skills and restaurant management principles, as well as employability skills.

The Culinary Competition requires students to demonstrate knife skills incorporated into cooking a three-course meal in 60 minutes with only two butane burners, two eight-foot tables and without the use of electricity or running water. The Management Competition requires students to develop a brand-new restaurant concept to pitch to a panel of industry and post-secondary judges, complete with critical thinking and verbal presentation rounds.


More than 100 industry and post-secondary judges and volunteers were on hand to select the winning teams. Students were evaluated on their uniform and professional appearance, teamwork, decision making ability, product taste, and overall menu appeal.


The two winning teams earned more than $10,000 in scholarships and the opportunity to compete against teams from other states at the National ProStart Invitational in Washington D.C. in May.

SCRLA to Honor Four Restaurants with Lifetime Achievement Awards https://www.scrla.org/news/619331/ https://www.scrla.org/news/619331/ The Greater Columbia Chapter of the South Carolina Restaurant and Lodging Association will host its annual Columbia Restaurant Hall of Fame and Benefit Dinner on November 21 at the Columbia Metropolitan Convention Center.

 

Five individuals, representing nine Midlands restaurants, will be presented with Lifetime Achievement Awards and inducted into the Columbia Restaurant Hall of Fame. This honor represents a significant accomplishment in South Carolina’s restaurant industry and is presented annually to the Columbia area restaurateurs that exemplify long-term success in this challenging business.

Hopes of Replenishing RRF Dashed by the Senate https://www.scrla.org/news/606103/ https://www.scrla.org/news/606103/ Yesterday, the United States Senate failed to replenish the Restaurant Revitalization Fund (RRF), leaving 2,100 restaurants in South Carolina and 177,000 nationwide behind.

 

The $48 billion Small Business COVID Relief Act of 2022 (S. 4008), introduced by Senators Ben Cardin (D-MD) and Roger Wicker (R-MS), included $40 billion for RRF replenishment and $8 billion in support for other industries deeply impacted by the pandemic. The House passed the Relief for Restaurants and other Hard Hit Small Businesses Act of 2022 (H.R. 3807), that included $42 billion to replenish the RRF, on April 7. Both political parties agreed that the RRF should be replenished but couldn’t reach a consensus on how to pay for it.

 

Despite the best efforts of the South Carolina Restaurant and Lodging Association, the National Restaurant Association, and our members, round two failed by a vote of 52-43. Disappointingly, Senators Lindsey Graham and Tim Scott from South Carolina voted against invoking cloture to overcome the filibuster (60 votes were needed).

 

The SCRLA will continue to fight for South Carolina's hospitality industry— one of the top economic drivers in our state, supporting one in every 10 jobs. We want to thank our members who joined in our grassroots efforts and contacted their elected officials, even though the outcome is not what we had hoped. Along with our partners at NRA, we will continue searching for any further opportunities to address much needed relief. This may appear to only be a “restaurant issue”, however, hotels and venues were impacted as well.

He is responsible for assisting in the development and execution of SCRLA’s state and local government affairs strategies and public policy agendas.

Davis will also educate and lobby the South Carolina General Assembly on issues related to the hospitality and tourism industries.

“Adding a position dedicated to public policy to our in house team was a strategic decision," said Susan Cohen, President and CEO of the SCRLA. "The importance of restaurants and hotels in our state’s economy, as well as the issues still challenging our industry, demands the undivided attention of a representative speaking to the legislature on our behalf.”

“For more than 75 years, the SCRLA has served as the preeminent voice of South Carolina’s hospitality industry," said Davis. "I am honored to be joining such an impressive association and look forward to serving our members, as well as advocating on behalf of their interests”.

Prior to joining the SCRLA, Davis served as Associate Vice President of Client Relations at DDC Public Affairs, a full-service public affairs firm in Washington, D.C. During his tenure at DDC, he worked on a variety of grassroots and political advocacy campaigns in the aerospace, defense, healthcare, insurance, and renewable energy industries at both the state and federal level.

Davis is a graduate of Wofford College with Bachelor of Arts degrees in history and government with a concentration in political theory. While attending Wofford, he served as Student Body President where he won the William Light Kenney Award and the Heart of the Terrier Award for his leadership, scholarship, and service to the Wofford community.

SC ProStart Students Cooking Up Quality Concoctions at Upcoming Events https://www.scrla.org/news/600742/ https://www.scrla.org/news/600742/ March 30, 2022 (Columbia, SC)— South Carolina ProStart students from the Midlands will demonstrate their culinary skill set at two events later this week— A Taste of Lake Murray on March 31 and Columbia Food and Wine’s Kids Can Cook Too! event on April 2.

ProStart® is a nationwide career and technical education program that unites the foodservice industry and the classroom to teach high school students culinary skills and restaurant management principles, as well as employability skills.

A Taste of Lake Murray, an annual fundraiser hosted by Capital City Lake Murray Country at the DoubleTree by Hilton Columbia, will feature students from Lexington Two Innovation Center (L2IC) among 15 other local restaurants. L2IC will prepare pan-seared striped bass tacos with fish locally sourced from Lake Murray.

“This is truly a ‘Taste of Lake Murray’ this year with Lexington Two student chefs serving locally sourced striped bass,” said Miriam Atria, President/CEO of Capital City/Lake Murray Country Regional Tourism Board. “We extend our sincere gratitude to the Midlands Striper Club for providing the fish used in the students’ dish.”

In its fifth year, the Columbia Food and Wine Festival is a one-of-a-kind gastronomical journey through Columbia’s finest plates and pours. L2IC ProStart students will assist the Flour Power Cooking Studio team who will instruct Kids Can Cook Too! During this event, kids aged 10 years and below will make personal pizzas and cheesecake parfaits from scratch, while learning about cooking and kitchen safety.

While classroom experience is necessary to learn foundational culinary and management skills, nothing beats real-life experience gained by working in the industry. ProStart students learn how to be an industry professional through hands-on work under the direction of a mentor.

Many of these students seek careers in the restaurant and foodservice industry and will go on to earn their culinary arts and/or hotel, restaurant and tourism degrees.

Anderson Career and Technology Center Sweeps 2022 South Carolina ProStart Invitational Competitions https://www.scrla.org/news/598724/ https://www.scrla.org/news/598724/  

 

The South Carolina Restaurant and Lodging Foundation (SCRLF) hosted its 16th Annual South Carolina ProStart Invitational on March 7 at the DoubleTree by Hilton Columbia. Approximately 100 students from 16 high schools demonstrated their business acumen and culinary arts skill set at the statewide competition.  


Students from Anderson Career and Technology Center won first place in both the Culinary Arts and Restaurant Management Competitions. The school serves nearly 2,000 students from Belton-Honea Path, Palmetto, Powdersville, and Wren High Schools in the Anderson I & II School Districts.

“If the COVID-19 pandemic has taught us anything, it is that we have to get our workforce back,” said Susan Cohen, President and CEO of the SCRLA. “This competition is one of the most important things we do. These students are learning about lifelong careers and skills that they will take with them past high school and, in turn, help advance the hospitality industry for us in the future.”

ProStart is a national two-year program offered at participating schools across the country for high school juniors and seniors interested in the culinary arts. Established in 1999, South Carolina's ProStart is run by the SCRLF and the National Restaurant Association Education Foundation, and provides high school and college academic credit, scholarships, and paid work opportunities for students. The program is much more than a typical high school curriculum as it unites the foodservice industry and the classroom to teach high school students culinary skills and restaurant management principles, as well as employability skills.

The Culinary Competition requires students to demonstrate knife skills incorporated into cooking a three-course meal in 60 minutes with only two butane burners, two eight-foot tables and without the use of electricity or running water. The Management Competition requires students to develop a brand-new restaurant concept to pitch to a panel of industry and post-secondary judges, complete with critical thinking and verbal presentation rounds.

More than 80 industry and post-secondary judges and volunteers were on hand to select the winning teams. Students were evaluated on their uniform and professional appearance, teamwork, decision making ability, product taste, and overall menu appeal.

The two winning teams earned more than $10,000 in scholarships and the opportunity to compete against teams from other states at the National ProStart Invitational in Washington D.C. in May.

Frits succeeds Bobby Williams, President and CEO of Lizard’s Thicket Restaurants, who served as Chairman for two years prior.

 

“It is my absolute pleasure to be working with the team at SCRLA to continue the phenomenal work they have done to help guide our industry through growth, innovation, and most recently, the challenges of the pandemic,” said Frits. “As we embrace the culture of the ‘new normal’, I look forward to working with the SCRLA and the board of directors to further South Carolina’s hospitality industry.”

 

Frits has spent more than 30 years as a manager in the lodging industry, leading hotels across the United States including: Hilton Atlanta, Hilton Anatole in Dallas, The Palmer House Hilton in Chicago, Capital Hilton in Washington, D.C., Hilton San Francisco, and Hilton Anchorage. Frits recently transitioned the independent Springmaid Beach Resort into the DoubleTree Resort by Hilton Myrtle Beach Oceanfront, a 453-guest room resort which sits on 27 acres at the south end of Ocean Boulevard. The resort offers more than 40,000 square feet of meeting space.

 

Frits graduated from the University of Wisconsin-Stout in 1992 with a Bachelor of Science in Hotel and Restaurant Management.

The Rise of the ‘New’ Traveler is Transforming the Industry

 

The hotel industry will continue moving toward recovery in 2022, but the path will be uneven and potentially volatile, and full recovery is still several years away, according to the American Hotel & Lodging Association (AHLA)’s 2022 State of the Hotel Industry Report.The report, which reveals shifts in consumer and business sentiment, was created in collaboration with AHLA Silver Partner Accenture and is based on data and forecasts from Oxford Economics and AHLA Platinum Partner STR.

 

The top findings of the report include:

  • Hotel occupancy rates and room revenue are projected to approach 2019 levels in 2022
  • The outlook for ancillary revenue, which includes food & beverage and meeting space, is less optimistic
  • Hotels lost a collective $111.8 billion in room revenue alone during 2020 and 2021
  • Leisure travelers will continue to drive recovery: in 2019, business travelers made up 52.5% of industry room revenue; in 2022, it is projected to represent just 43.6%
  • Business travel is expected to remain down more than 20% for much of the year, while just 58% of meetings and events are expected to return; the full effects of Omicron are not yet known
  • Changing traveler segments, including the rapid rise of bleisure travelers—those who blend business and leisure travel—are impacting how hotels operate. In fact, one study of global business travelers found 89% wanted to add a private holiday to their business trips in the next twelve months
  • In this new environment, technology will be even more critical to a property’s success, according to AHLA Platinum Partner Oracle Hospitality—with hotels investing in technology to meet the needs of both guests and employees today and in the future

 

“Hotels have faced enormous challenges over the past two years, and we are still a long way from full recovery. The uncertainty about the Omicron variant suggests just how difficult it will be to predict travel readiness in 2022, adding to the challenges hotels are already facing,” said Chip Rogers, president and CEO of AHLA. “The slow return of business travel and fewer meetings and events continue to have a significant negative impact on our industry. The growth of leisure and bleisure travel represents a shift for our industry, and hotels will continue evolving to meet the needs of these ‘new’ travelers.”

 

“Travel and hospitality brands still face an uncertain marketplace, but all these changes also herald a new era of opportunity to drive long-term customer loyalty. They should flex with demand and respond to the added complexities and volatility in travel by delivering a ‘travel partner’ mentality to their leisure and business customers,” said Liselotte De Maar, managing director in Accenture’s travel industry. “Travelers are now not only focused on price and quality of a location, but also on cleanliness and sustainability values and impact, and expect a clearer, more digital service. Companies will need to continue to digitally transform, reinvent their loyalty model, as well as rethink the employee proposition, if they wish to thrive.”

 

Like other industries, hotels have been dealing with a major workforce shortage which could impact recovery. The AHLA Foundation is launching a new, national, multichannel ad campaign to help fill the hundreds of thousands of open jobs in the hotel industry. The pandemic wiped out 10 years of job growth. This multi-year effort, “The Hotel Industry: A Place to Stay,” aims to helpjob seekers discover the 200+ career pathways and many perks that the industry offers, including competitive wages, benefits, flexible schedules, and travel opportunities. Ads will begin running in Columbus, Dallas, Denver, Miami, and Phoenix on Facebook, Google, and Youtube in both English and Spanish.
